The Lord Mayor opened the meeting by expressing condolences on his own behalf and on behalf of the City Council to the families and friends of the following recently deceased:

·        Geraldine (Ger) Mullen who worked in the IS Department who died Saturday 15^th April

·        Treasa Ni Raghallaigh  (O’Reilly), who died on 20^th April, Mother of Deirdre Ní Raghallaigh

·        Catherine Humphreys Mother of former Councillor and Deputy Lord Mayor, Senator Kevin Humphreys

All stood for a minute’s silence as a mark of respect for the deceased.

The Lord Mayor then welcomed Mr Richard Shakespeare who has recently been appointed Assistant Chief Executive to the Planning & Property Development Department of Dublin City Council. He then extended congratulations to Councillor Hazel De Nortúin on the birth of her daughter, Zara and he also congratulated Councillor Claire O’Connor on her recent engagement and wished her and her fiancé every happiness in the future.

A Presentation on the River Basin Management Plan was made by Gerard O’Connell, Engineer-in-Charge, Regional Projects & Flood Advisory Office, Dublin City Council to inform members as part of the National Consultation process - "Draft River Basin Management Plan for Ireland 2018-2021" - see Appendix A to these Minutes. Members were advised to email their questions to Mr O’Connell for response. The Lord Mayor then sought and was granted approval for Councillor attendance at Victim Support Europe Annual Conference: "Victims of Crime: Rights, Needs & Responses". He also informed Members that Minister Coveney would attend the June City Council meeting and it was suggested that time be allowed for Members to pose questions to the Minister at that meeting.

He then informed Members that a Special Meeting of the City Council would take place on the 18^th May @ 3.30pm to consider the Poolbeg West SDZ.. The Lord Mayor then announced that, at the request of seven Members, another Special meeting will be held on the 22^nd May, starting @ 5pm This Special Meeting on the 22^nd May will discuss a Service Delivery Plan for Dublin City Council.

It was moved by Councillor V Jackson and seconded by Councillor C Burke “That Dublin City Council approves the Dublin Chief Executive answering the questions lodged”. The motion having been put and carried, written answers to the 141 questions lodged for the City Council meeting were issued. The Questions and Answers are set out in Appendix B attached.

The minutes of the Meeting of the City Council held on the 3rd April  2017, having been printed, certified by the Meetings Administrator, circulated to the Members and taken as read, were signed by the Lord Mayor. A correction of the proposer and seconder of Item 15 was requested and made.

It was proposed by Councillor N Reilly and seconded by Councillor R McGinley “That Dublin City Council notes the contents of Report No 151/2017”. The motion was put and carried.

It was moved by Councillor P McAuliffe and seconded by Councillor T Brabazon “That Dublin City Council notes Report No 150/2017 and hereby approves the contents therein”. The motion was put and carried.

The City Council agreed to defer the filling of thid vacancy for one month.

It was proposed by Councillor T Brabazon and seconded by Councillor P Bourke “That Councillor Vincent Jackson be appointed as a member to represent Dublin City Council on the Board of the Commissioners of Irish Lights” The motion was put and carried.

It was proposed by Councillor C Ni Dhalaigh and seconded by Councillor R McGinley “That Dublin City Council notes the contents of Report No 173/2017”. The motion was put and carried.

It was proposed by Councillor R McGinley and seconded by Councillor T Brabazon “That Dublin City notes Report No 152/2017 and adopts the Annual Financial Statements 2016 as outlined therein” The motion was put and carried.

It was proposed by Councillor C Ni Dhalaigh and seconded by Councillor R McGinley “That Dublin City Council notes the contents of Report No 172/2017”. The motion was put and carried. Members requested that any available information on an Affordable Rental Scheme be sent to them.

Councillor N O Muiri declared a conflict of interest and withdrew from the meeting. Councillors M MacDonncha, C Byrne and the Lord Mayor declared that they sat on the Board of The National Maternity Hospital, Holles St, but there was no conflict of interest so were staying for the discussion and decision on this item.  It was proposed by Councillor R McGinley and seconded by Councillor M Flynn “That Dublin City Council notes the contents of Report No 153/2017 and hereby approves the submission as set out therein”  The motion was put and carried.

The City Council then approved the following three resolutions to be appended to the City Council’s submission when it is submitted to an Bord Pleanála.

(a)       "Dublin City Council recommends that the proposed development be under the control of the State and suggests that an Board Pleanála may wish to include this recommendation by way of planning condition for the management of the facility. Reasons: to ensure the provision of all medical services that reflect the designation of the facility as the 'National Maternity Hospital'."

(b)        "That Dublin City Council recommends that all parking at the Hospital be free          to persons with disability passes."

It was proposed by Councillor P McCartan and seconded by Councillor D Flanagan “That Dublin City Council notes the contents of Report No 140/2017 and hereby ratifies the membership of the Local Community Development Committee (LCDC) as set out therein”. The motion was put and carried.

It was proposed by Councillor R McGinley and seconded by Councillor P Bourke “That Dublin City Council notes the contents of Report No 175/2017”. The motion was put and carried.

It was proposed by Councillor R McGinley and seconded by Councillor A Connaghan “That Dublin City Council notes the contents of Report No 148/2017 and assents to the proposal outlined therein” The motion was put and carried. It was agreed that a feasibility study as requested by Councillor Flynn would be undertaken by the Arts Officer.

It was brought to the attention of the Members that there had been a mis-spelling in the report when it was first circulated but a corrected version had then been circulated to all Members. It was proposed by Councillor A Clancy and seconded by Councillor M Flynn “That Dublin City Council notes the contents of Report No 165/2017 and assents to the proposal outlined therein” The motion was put and carried.

It was proposed by Councillor R McGinley and seconded by Councillor M Flynn “That Dublin City Council notes the contents of Report No 167/2017 and assents to the proposal outlined therein”

An Amendment to this report as follows was put forward by Councillors T MacVeigh, C Perry, A Keegan, J Lyons, E Ryan, P Dunne and H De Nortuin and agreed by the City Council.

“To amend the proposal contained in the report (No 167/2017) seeking to vary Report No 357/2016 so as not to approving the sale of three apartments:

·        5 Block 1, New Priory, Hole in the Wall Road, Dublin 13 to NPH Avenue Investments Limited

·        8 Block 1, New Priory, Hole in the Wall Road, Dublin 13 to NPH Avenue Investments Limited

·        3 Block 1, New Priory, Hole in the Wall Road, Dublin 13 to Julie Gannon

Furthermore that this individual and the firm of which she is a director in whose name two of the purchases are being made have their booking deposit returned and Dublin City Council resolves that units it owns shall not be sold to property or investment firms and where sales do take place they are to named individuals who intend living in said units”

The amended motion, to approve all the disposals listed in Report No 167/2017 with the exception of those three listed and described above, 5 Block 1, 8 Block 1 and  3 Block 1, was then put and carried.

Councillor E Ryan proposed and Councillor T MacVeigh seconded an amendment to this report which was to delete clause no 16 from the report. This amendment was defeated. It was then proposed by Councillor N Ring and seconded by Councillor M Flynn “That Dublin City Council notes the contents of Report No 168/2017 and assents to the proposal outlined therein” The motion was put and carried.

It was proposed by Councillor R McGinley and seconded by Councillor V Jackson “That Dublin City Council notes the contents of Report No 169/2017 and assents to the proposal outlined therein” The motion was put and carried.

Councillor E Ryan withdrew an amendment similar to her proposed amendment to Report No 168/2017 which was defeated. It was then proposed by Councillor N Ring and seconded by Councillor C Burke “That Dublin City Council notes the contents of Report No 170/2017 and assents to the proposal outlined therein” The motion was put to a Roll Call Vote and carried. It was proposed by Councillor M Flynn and seconded by Councillor R McAdam “That Dublin City Council notes the contents of Report No 145/2017”. The motion was put and carried. Following discussion, it was agreed that the matter of councillors being charged for making planning submissions would be referred to the Protocol Committee who would also take cognisance of the information received from the DoHPCLG in this regard.

It was proposed by Councillor N O Muiri and seconded by Councillor T Keegan “That Dublin City Council notes the contents of Report No 142/2017”. Cllr N O Muiri requested that a correction be made in this report – replace the words left/right turn’ with ‘left turn’ This was agreed by the City Council. The motion was then put and carried.

It was proposed by Councillor A Gilliland and seconded by Councillor C Burke “That Dublin City Council notes the contents of Report No 154/2017”. The motion was put and carried.

It was proposed by Councillor D Doolan and seconded by Councillor M Flynn “That Dublin City Council notes the contents of Report No 155/2017”. The motion was put and carried.

It was proposed by Councillor M Flynn and seconded by Councillor R McHugh “That Dublin City Council adopts Report No 143/2017”.

The Lord Mayor requested that the meeting be adjourned at 9.05pm for ten minutes to allow members of the Protocol Committee to withdraw to the Richard O’Carroll Room to discuss issues of a possible conflict of interest raised in a letter received by the Chief Executive’s Office and by the Vice Chair of the Protocol Committee in relation to a motion listed on the breviate. When the meeting resumed, the Chair of the Protocol Committee, Cllr D Lacey, informed the City Council that it was agreed by the members of the Protocol Committee that there was no conflict of interest involved and that consideration of the breviate including the motion in question could proceed.

An amendment to the motion, Item 3 on the breviate was put forward by Councillor A Feeney and seconded by Councillor N O Muiri but was defeated. Full details of that amendment can be found in Appendix D to these minutes. Report No 143/2017 containing the un-amended motion at Item no 3 was then put to a vote and approved.
