Lord Mayor's Business Additional documents: Minutes: The Lord Mayor opened the meeting by expressing condolences on his own behalf and on behalf of the City Council to the families and friends of the following recently deceased:
· The victims of the terrorist attacks in Dublin’s Sister City Barcelona and Cambrils on Thursday 17th August. A Book of Condolence was opened in the Mansion House for the people of Dublin to express their sympathy and solidarity with the people of Barcelona. The Lord Mayor also wrote to the Spanish Ambassador to Ireland and the Mayor of Barcelona to express the sympathies of the people of Dublin.
· Mrs Olive Bell; The mother of former Lady Mayoress Jill Lacey who lived in the Mansion House with Lord Mayor Dermot Lacey and Jill during their term as Lord Mayor of Dublin who died on 24th August, 2017.
· Susan Jackson; The aunt of Councillor Vincent Jackson who died aged 105 years. She was a regular visitor to the Mansion House on her birthday.
· Members of the Homelessness Community who died over the past week. Jack Watson who died on Dublin’s Suffolk Street, Danielle Carroll who died in Leixlip and Jenny Dennehy who died in Cork.
· The anniversary of the death of City Council employee Trevor O’Neil. All stood for a moments silence as a mark of respect for the deceased.
The Lord Mayor informed Members that the “Nuclear Free Local Authorities (NFLA) All Ireland Forum” was hosting an Autumn Seminar on Friday 22nd September in Buvinda House, Meath County Council. It was agreed that a City Council nominee could attend and that any Member who was interested should contact the Chief Executive’s Office.
The Lord Mayor notified Members that Minister for Housing, Planning and Local Government, Eoghan Murphy T.D. was willing to meet the Council to discuss the Housing crisis but not until the publication of the review of the Governments “Rebuilding Ireland” Action Plan.
The Lord Mayor extended congratulations to the following:
· Cllr. Declan Flanagan on the birth of his daughter. · Cllr. Janice Boylan on her recent engagement. · The Dublin Men and Women’s GAA football teams on reaching their respective All Ireland Finals · The Irish Men and Women’s Homeless Football teams on their success at the Homeless World Cup in Norway. |

Dublin City Council agrees that in conjunction with the works agreed under the Part 8 procedure for the Herbert Park to Donnybrook Road Dodder Flood Relief Works/Greenway listed at Item 7(b) on the agenda for the Council meeting of the 4th September 2017 to request the Chief Executive:
1. To engage in meaningful discussions with the Bective Lawn Tennis Club to agree: a) Prior to commencement on site, Dublin City Council (DCC) shall liaise with Bective Tennis Club (BTC) and for the duration of the project: b) Agree with BTC terms for access to the Bective Tennis Club grounds for the purpose of its works, including scheduling of works to completion. c) Remediate any damages to the lands caused by the works, including fencing planting, pathways, security, screening measures and reinstatement of playing surfaces. d) Agree with BTC the boundary treatment prior to completion of detailed design stage. e) Review the provisions for Eglinton Terrace including upgrading of fencing as part of the overall Dodder Greenway Project.
2. To enhance the proposed greenway as an amenity by: a) Including in the implementation of the scheme, measures for restoration of habitat and character of the riverbank as far as reasonable and practical in consultation with the National Parks Wildlife Services and DCC Parks and Landscape Services. b) Provide seating and viewing points along the greenway. c) Consider the proposal for a supplementary route via Eglinton Terrace as part of the overall Dodder Greenway. d) Provide appropriate public lighting for the route as part of the overall Dodder Greenway. e) The height of the flood defence wall shall be kept to a maximum height of 1.1metres above the level of the greenway. 3. In order to ensure adequate community engagement, continue to liaise with the Dodder Action Group in the implementation of the scheme.

(a) The City Council suspended Standing Orders to agree the following emergency motion to be taken with motion No. 6 on the agenda from the South Central Area Committee without debate:
This City Council asks that the Chief Executive begin the process of taking the Iveagh Markets back into the full control of Dublin City Council. The terms of the lease granted to Mr Keane, first in 1997 and then again in 2004 under report number 218/2004 have been frustrated by the actions of the developer.
Report number 218/2004 clause 7 states that "Mr Keane or his nominee shall, within 36 months of the execution of the Agreement for Lease, have completed the redevelopment work on the market buildings and the construction of the hotel in the case of delay due to strikes, lockouts or any other circumstances outside the control of Mr Keane or his nominee. Such longer period if required to be agreed with Dublin City Council at the time the delay occurs. Mr Keane or his nominee shall not use the premises for any purpose other than redevelopment as a commercial market and the construction of a hotel".
Clause 12 “Dublin City Council reserves the right to re-enter on the entire property and resume possession thereof should Mr Keane or his nominee fail to commence and complete the redevelopment and construction works within the specified period or in the event of bankruptcy or insolvency of Mr Keane or his nominee, save in the case of a financial institution which has entered into a mortgage with Mr Keane or his nominee for the purposes of financing the redevelopment and construction works”
The terms of this extension of the lease have not been met and so Dublin City Council should begin the process to transfer the markets back into their full control with a view to developing the Iveagh Market as per Clause 12.

It was proposed by Councillor N Ring and seconded by Councillor P McAuliffe "That the Members of Dublin City Council support the proposal in Seanad Éireann to recognise January 21st as the Declaration of Independence Day, the Private Members Bill for which has passed its Second Stage in Seanad Éireann with cross-party support including that of the Government. The Bill will formally recognise the meeting of the First Dáil and the Declaration of Independence made on 21 January 1919 and provide for a Declaration of Independence Day to be held on 21 January annually. There is no plan to legislate for this day to become a public holiday, the legislation as proposed would allow schools, public bodies and community groups an opportunity to commemorate this hugely important day in a very appropriate way". Bliain na Gaeilge is co-ordinated by over 50 Irish language and Gaeltacht groups. The City Council will support and play an active role in Beo 2018, a celebratory cultural parade and street concert that will be organised on 3 March 2018 in the City as an integral part of Bliain na Gaeilge 2018)”.
