Emergency Motion(s) –:

 

(a)        The City Council suspended Standing Orders to agree the following emergency motion to be taken with motion No. 6 on the agenda from the South Central Area Committee without debate:

 

This City Council asks that the Chief Executive begin the process of taking the Iveagh Markets back into the full control of Dublin City Council. The terms of the lease granted to Mr Keane, first in 1997 and then again in 2004 under report number 218/2004 have been frustrated by the actions of the developer.

 

Report number 218/2004 clause 7 states that "Mr Keane or his nominee shall, within 36 months of the execution of the Agreement for Lease, have completed the redevelopment work on the market buildings and the construction of the hotel in the case of delay due to strikes, lockouts or any other circumstances outside the control of Mr Keane or  his nominee. Such longer period if required to be agreed with Dublin City Council at the time the delay occurs. Mr Keane or his nominee shall not use the premises for any purpose other than redevelopment as a commercial market and the construction of a hotel".

 

Clause 12 “Dublin City Council reserves the right to re-enter on the entire property and resume possession thereof should Mr Keane or his nominee fail to commence and complete the redevelopment and construction works within the specified period or in the event of bankruptcy or insolvency of Mr Keane or his nominee, save in the case of a financial institution which has entered into a mortgage with Mr Keane or his nominee for the purposes of financing the redevelopment and construction works”

 

The terms of this extension of the lease have not been met and so Dublin City Council should begin the process to transfer the markets back into their full control with a view to developing the Iveagh Market as per Clause 12.

(B)       The City Council suspended Standing Orders to agree the following two emergency motions to be taken without debate:

 

Dublin City Council:

·        Eexpresses deep regret and concern at the tragic deaths of homeless people in Dublin in recent days,

·        Extends our deepest sympathy to their families and loved ones,

·        Is committed to working with the Government and homeless services to eliminate homelessness,

·        Calls on Minister for Housing Eoghan Murphy to meet with Dublin City Council as a matter of urgency to discuss funding a building programme that meets the housing needs of Dublin City Council.

That the CEO makes a statement to the elected members on the recent deaths of homeless men and women in the last 7 days.

(C)       The City Council suspended Standing Orders to agree the following two emergency motions to be taken without debate:

 

That Dublin City Council:

 

·        Notes that two of the five schools built under the 2008 rapid build programme found not to be fire compliant are in the Dublin City Council area namely Belmayne Educate Together School and St Francis of Assisi National School Belmayne

 

·        Further notes that the inspections of these schools and the findings of non-compliance by the Department of Education took place in October 2015 but knowledge of the non-compliance in these five cases only became public knowledge on 1st September 2017

 

·        Further notes with concern the efforts made by the Department of Education throughout the year to not make the findings of these inspections public when subjected to a Freedom of Information request by the Dublin Inquirer newspaper.

 

·        Calls for the Department of Education to make prompt contact with the principal, staff representatives and parents representatives of all the affected schools and provide them with the necessary reassurance that all remedial measures have been taken to make the school buildings safe

 

·        Calls for the prompt delivery of the promised permanent builds for Belmayne Educate Together and St Francis of Assisi National Schools

 

·        Requests that the Chief Fire Officer reports on the quantity of public and commercial buildings and domestic dwellings built in the Dublin City Council area that have been self certified as fire safety compliant by the construction industry and furthermore what resources would be required for Dublin City Council to conduct a comprehensive fire safety compliance inspection of all of these buildings.

This City Council recognises the serious fire issues discovered by recent Department of Education fire safety audits at several rapid build schools in North Dublin installed by Western Building Systems Ltd, who used single layers of 12.5mm plasterboard in parts of the buildings construction which would not achieve sufficient fire resistance to provide the required time for evacuation and requests comment from the manager on whether such construction practices have been used in the city council's residential rapid build homes.

 

Furthermore, the elected members request a detailed report from the city's Fire Officer on the proposed remedial works the Department of Education believes will address the serious fire issues discovered at two rapid build schools in Belmayne, North Dublin - Belymayne Educate Together and ST. Francis of Assisi - and to provide information to the elected members as to what contingency plans have been to put in place in both schools to ensure the safety of the school children, teachers and parents until the proposed works commence on September 17th.
