Local Councillors demand urgent clarity regarding the failure to comply with building regulations at Oscar Traynor Woods.

Although we are glad to see inspections happening on site, delays cannot be permitted in providing such an important social and affordable housing development in the area.

We want to know the extent and nature of the issues discovered, how and when they will be resolved and how further communication with residents and local representatives improved.

Local Councillors demand urgent clarity regarding the failure to comply with building regulations at Oscar Traynor Woods.

We want to know the extent and nature of the issues discovered, how and when they will be resolved and how further communication with residents and local representatives improved.

 

In response to the request from the group leaders with regards to Mot 7b (2), DCC Housing Development wish to outline the current procedures in place and the subsequent involvement of the Building Control Section of Dublin City Council. 

This report describes the role and activities of the various stakeholders in relation to the recent and ongoing building works that have been carried out at the Oscar Traynor Road site, Dublin 17. 

Glenveagh Living Limited are constructing 853 residential units in a number of phases at Oscar Traynor Road. The development includes houses, apartments and duplexes as well as community and crèche buildings.

Among the team who design, inspect and certify works in accordance with Building Regulations are the Assigned Certifier, Project Architects, Structural Engineers, Fire Safety Consultants, Access Consultants and other specialist technical advisors as required.

Separately, Dublin City Council have a Technical Due Diligence Team made up of technical experts in the area of building construction for the purposes of monitoring works and ensuring the developments’ compliance with building regulation standards and quality generally. This team includes Clerk of Works, Architects and Engineers. These inspectors have been engaged in the daily inspection of construction works since the project commenced. These inspections regularly identify items that require remediation. The issue identified is uploaded to a portal where it is assigned to the relevant technical person. The advisor comments and or actions the item and the matter is referred back to the technical due diligence team for further comment or for closing out. This is the industry norm for identifying and tracking items of non-compliance with building regulations and or the works requirements. The matter remains open until the technical due diligence team is satisfied the item is in compliance with Building Regulations and or the Works Requirements. 

As with every construction project undertaken in the state, this project may be the subject to inspections by the Building Control Authority. Over the past three months a number of technical issues arising with respect to building regulation compliance were identified as part of the above outlined inspection regime.. Glenveagh are currently engaging with Building Control personnel to demonstrate that all works are compliant with Building Regulations and where works are not compliant they will be setting out what works are required to rectify these and ensure compliance with Building Regulations. .

When a development is complete, there is a requirement for the developer to secure a Certificate of Compliance. The developer is required to submit the necessary information to Building Control and the final decision to accept or reject a Certificate of Compliance on Completion rests with the Building Control Authority in accordance with the provisions of the Building Control Regulations 1997 to 2024 and so it is imperative that Glenveagh fully satisfy Building Control. They are actively engaged and working towards ensuring this. 

The project is in the early stages of construction and is ultimately scheduled for full completion in early 2028. Currently Glenveagh are endeavouring to occupy the first units in the scheme by the end of 2025.

Dublin City Council and Glenveagh will continue to engage with all stakeholders on this development to ensure full compliance with building regulations and ensure the highest standards are implemented.

As per the request set out in this motion DCC Housing have scheduled the next meeting of the Oscar Traynor Road Consultative Forum for Friday the 24th January and Glenveagh will be in attendance. Glenveagh continue to issue regular newsletters regarding progress on the project to residents and local representatives.

As the Building Control Authority has a statutory regulatory and enforcement role under the provisions of the Building Control Acts, it is not proposed to comment in any further specific detail as the compliance issues remain under active consideration.

Housing Development note whilst we cannot get into the specific detail, below is an example of some of the issues that have arisen and Glenveagh are actively repairing. 

  • The quality of some non-load bearing brickwork requires remediation;
  • Moisture was noted at the base of some internal plasterboards;
  • Damage to some plasterboard requires replacement;
  • Some materials not stored correctly;
  • Water ingress to some dwellings where roofing was incomplete.
