Information relevant to City Development Plan Zoning and Variations:

a)    Section 10 of the Planning Act 2000 requires that the zoning of land shall be for particular land use purposes (whether residential, commercial, industrial, recreation, open space etc or a mixture of those uses) in order to achieve the proper planning and sustainable development of the area. As such, land ownership is not a material planning consideration in the zoning of land.

 

b)    City Development Plan zonings, and variations thereto, relate to broad categories of land use. They do not address issues such as height – (which are a matter of urban form and design), or housing tenure.

 

c)     Section 13 of the Planning Act 2000 states that the members of the authority shall be restricted to considering the proper planning and sustainable development of the area to which the development plan relates, the statutory obligations of any local authority in the area and any relevant policies or objectives for the time being of the Government or any Minister of Government.

 

d)    Section 13(5) of the 2000 Act also requires the members of a planning authority to consider each proposed variation and the report of the Chief Executive.

Before the official business commenced Gerry Geraghty, Acting Head of HR and Corporate Services updated the members on COVID 19 and Business Continuity Planning.  All services fully operational at the moment.  Communications Team to be in place from tomorrow. Crisis Management Team in place and meeting regularly.

 

Councillor Lacey paid tribute to all the staff in emergency services and those in the public sector dealing with the Corona Virus who are working above and beyond at this present time.  This was endorsed by all members in the chamber.

 

Cllr Christy Burke requested that the Council pause for a moment to remember the young man who was found dead outside the Civic Offices earlier this morning.

 

Lord Mayor Cllr. Tom Brabazon left the chair at 4.10 p.m. to attend a short meeting of group leaders and was replaced by Deputy Lord Mayor Cllr. Racheal Batten.  The Lord Mayor returned to the chair at 4.22 p.m.

It was proposed by Councillor Terence Flanagan and seconded by Councillor Ray McAdam “That Dublin City Council adopts Report No. 77/2020 and makes Variation (No.8-27) to the Dublin City Development Plan 2016 – 2022 as outlined in the report”.

 

A general discussion took place on the overall report prior to voting on individual reports.

 

It was proposed by Councillor Pat Dunne and seconded by Councillor Tina MacVeigh that the report be put before the members and rejected in its entirety.  This was put to a vote and rejected.  Details of the vote are contained in Appendix A.

 

An amended table to the report was circulated by Management, including the withdrawal of three variations – Variation No. 9, No. 10 and No. 25.  The Chief Executive advised that the proposed modifications to Z10 mixed use from Z1 were not material.

Topical Issue - "Dublin City residential Rent Freeze"

Following contributions from all parties in the Chamber it was proposed by Cllr Mary Fitzpatrick that “The Elected Members of Dublin City Council call on the incoming Government to urgently introduce a minimum two year residential rent freeze in Dublin City”  This position was endorsed by all Members present in the Chamber. The Lord Mayor agreed to write to the Minister and all the leaders of the main political  parties.

 

The meeting concluded at 8.25 p.m.
