Information relevant to City Development Plan Zoning and Variations:

a)    Section 10 of the Planning Act 2000 requires that the zoning of land shall be for particular land use purposes (whether residential, commercial, industrial, recreation, open space etc or a mixture of those uses) in order to achieve the proper planning and sustainable development of the area. As such, land ownership is not a material planning consideration in the zoning of land.


b)    City Development Plan zonings, and variations thereto, relate to broad categories of land use. They do not address issues such as height – (which are a matter of urban form and design), or housing tenure.


c)     Section 13 of the Planning Act 2000 states that the members of the authority shall be restricted to considering the proper planning and sustainable development of the area to which the development plan relates, the statutory obligations of any local authority in the area and any relevant policies or objectives for the time being of the Government or any Minister of Government.


d)    Section 13(5) of the 2000 Act also requires the members of a planning authority to consider each proposed variation and the report of the Chief Executive.
