The Lord Mayor opened the meeting by extending his sympathies to the family, friends and colleagues on the death of Gay Byrne, particularly to Gay’s wife Kathleen Watkins and his daughters Suzy and Crona.  As Gay Byrne was a Freeman of the City from 11^th May 1999 the flags on all Civic Buildings will be flown at half-mast.  The Lord Mayor will also be opening a book of condolence at the Mansion House from 11 a.m.

Report from the Working Group on Remunicipalisation of the Domestic Waste Management Services in Dublin City Council:

The working group was established after a motion was passed at July's City Council meeting committing DCC to the remunicipalisation of the domestic waste collection and the establishment of a cross party working group. It also mandated the working group to report back to the November meeting. The working group met 3 times. The report was circulated to all Councillors and will be listed on the December agenda.

A vote was taken to suspend standing orders to deal with the following emergency motions (a copy of the vote is contained in Appendix A):

Dublin City Council expresses deep concern at the recent 'boil water' alert across Dublin. We welcome the publication of the EPA report on the Incident at the Leixlip Water Treatment Plant.  Irish Water & the Department of Environment must be held to account for their actions.  Dublin City Council calls on Irish Water and the Department of Environment to clarify; 

Why the March 2019 audit recommendations were not implemented?

Were the Department aware of this failure?

Emergency Motion No. 2

That Dublin City Council call on Irish Water to put in place the recommendations by the EPA to address the security of safe drinking water to the people of Dublin City and the greater Dublin area, after 600,000 homes were put on a boil water notice in October due to contamination at the Leixlip water treatment plant

In view of the Cultural importance of the house at 15 Ushers Island - The House of the Dead  - the location of the setting of the James Joyce story The Dead - for which a Planning Application has been submitted to convert to a Hostel.

Recognizing that this is a listed building.

Acknowledging that the elected members cannot determine a Planning Application

Dublin City Council calls on all interested Parties, including the Minister for Arts, Culture and Heritage to intervene to try and save this important building for future cultural and artistic use.

Members requested that the Manager write to the Minister for Housing, Planning and Local Government in relation to funding for retrofitting of housing stock.

It was proposed by Councillor Vincent Jackson and seconded by Councillor James Geoghegan “That Dublin City Council hereby approve the SCSI Tender Price Indexation rate of 6.6% is applied to the industrial/commercial development levy rate under the Section 48 Development Contribution Scheme 2016-2020 with effect from the 1^st January 2020”

The following amendment was proposed by Cllr. Janet Horner, Cllr. Caroline Conroy, Cllr Sophie Nicoullaud, Cllr. Donna Cooney, Cllr. It was proposed by Councillor Séamas McGrattan and seconded by Councillor Críona Ní Dhálaigh "That Dublin City Council notes Report No. 309/2019 to initiate the variation to the Dublin City Development Plan 2016 - 2022 as outlined in the report". The motion was put and carried.

It was proposed by Councillor Declan Flanagan and seconded by Councillor Vincent Jackson that Dublin City Council notes Report No. 311/2019 to initiate the variation to the Dublin City Development Plan 2016-2022 as outlined in the report.  The motion was put and carried.

At 8.30 p.m. it was agreed to suspend standing orders and defer motions to deal with items on the agenda. 

The Assistant Chief Executive, Brendan Kenny proposed the following amendments to Report No. 337/2019:

1.     Page 213 - Affordable Housing- Change, the highest price for the Affordable Purchase Homes will be € 310,000 not € 320,000.

2.     Page 214 - Paragraph on Land- Final sentence in bold, change Cost Rental to Affordable/Cost Rental.

3.     Page 215 - 7^thBullet point – Change, crèche to community crèche.

4.     Page 215 - 8^th Bullet Point – Change, delete the words ‘’will offset sunken costs…………… demolition etc.

5.     Page 215 - 9^th Bullet point – Change, delete the words ‘market prices’.

6.     General: A minimum of 3 Million Euro of the 7 Million paid by the developer will be ring-fenced for investment in Community/Cultural facilities on the separate but adjacent Dublin City Council site on Infirmary Road (northern end). This particular part of the project will be prioritised by DCC.

It was proposed by Councillor Deirdre Heney and seconded by the Lord Mayor Councillor Paul McAuliffe that Dublin City Council notes the contents of Report 337/2019 as amended. The motion was put and carried.

The Assistant Chief Executive, Brendan Kenny proposed the following amendments to the report which were agreed.

1.     Item number 6 – Page 220: Clarification, the project involves a total of 824 homes, 56 of these homes are already being developed by Dublin City Council on the site- 30% of 824 amounts to 247 subtract 56 equals 192. The Developer is providing 192 Social Units for DCC but there will be a total of 247 Social Units on the site. At the initial stage of the project it was indicated in the procurement process that there would be a maximum of 30% Social Units on the overall site.

2.     Item number 13 – Page 221: Add in the following at end of sentence, however the Owners Management Company will make a joint decision with DCC on the appointment of a Management Company for the development, a condition of such appointment will be the commitment to decent employment practices. 

3.     Item number 18 – Page 221: Add in the following at the end of sentence, This Clause will aspire to a minimum of 20% of the workers on site to be taken from the live register (including an Apprenticeship Programme) representing opportunities for local employment.

It was proposed by Councillor Deirdre Heney and seconded by the Lord Mayor Councillor Paul McAuliffe That Dublin City Council notes the contents of Report No 332/2019 as amended and assents to the proposal outlined therein”. The motion was put to a vote and carried.  Results of this vote are contained in Appendix D.  Cllr. Christy Burke and Cllr Séamas McGrattan unintentionally failed to register their vote but wished to make it known that they would have voted against the proposal.
